2.1 Engineering contracts
Engineering contracts focus on the development of the infrastructure and transportation of the baseball practice field and on the planning of the baseball field proper. The engineering contracts include the detailed description of the works to be done. To put it more precisely, the engineering contracts are supposed to meet the following goals: the owner of the baseball field needs to have the detailed, well-developed plan of the construction of the baseball practice field, cultivation and planting of the field, the construction of the infrastructure and transportation system and the parking place of the baseball practice field.
2.2 Construction contracts
The construction contracts focus on the fulfillment of obligations on the construction of the baseball practice field, infrastructure and transportation system and the parking place. The construction contracts imply the fulfillment of construction works proper.
3. PROPOSAL
3.1 Breakdown of bid price
The bidders should establish their prices, while the owner chooses the best option. The breakdown price is the price that meets the interests of the owner and is the lowest price among all the bidders made. At the same time, the owner chooses the best match of the low price, high quality of work, and time of the completion of the project.
3.2 Revisions and extra work
The contract includes revisions and possible extra work that may have to be done after the completion of the project. In case of revelation unexpected difficulties, the bidder should come prepared to fulfill the extra work on the price, which the bidder and the owner negotiate. If the owner and the contractor fail to come to agreement upon the revisions and extra work, the owner has the right to hire another contractor. If the revisions are needed because of the poor performance of the contractor, the contractor should do revisions free of charge or compensate the costs of the revisions to the owner of the field. Any extra work should be negotiated.
3.3 Escalation formulas
The escalation formulas should include the possible inflation rate and changes in the price of materials used in the construction. Therefore, the escalation formulate will be as follows: the original price x the inflation rate in the building materials = the price the owner has to pay to the contractor. The price should be revised quarterly.
3.4 Scheduled completion dates
The completion date is March 10, 2013. The contractor should build the field by May 2012. From June 2012 to March 2013 the contractor should complete the construction of the infrastructure and transpiration system along with the parking place.
3.5 List of subcontractors
The list of subcontractors should be presented to the owner of the baseball field before the beginning of the construction and implementation of the project. In fact, the bidder should provide the list of subcontractors as a part of the plan. The list of subcontractors should be presented as the appendix to the plan with the detailed description of subcontractors. At the same time, the contractor is responsible for the proper fulfillment of obligations of subcontractors. In case of their failure, the contractor fulfills their obligations and does revisions to complete the project respectively to the plan.
3.6 Key supplier or contractor personnel
The contractor should also provide the detailed information on the key supplier and personnel that will work on the completion of the project. The information should include the information on the amount of professionals working on the project, the time of work, the duties and obligations of employees, and their functions.
3.7 Length of time the bid is valid
The bid is valid in the course of the three weeks while the bid is sent to the owner and in the course of two weeks, while the bid is considered by the owner of the baseball field. The three bidders selected by the owner will send new bids, which are valid until the completion of the bid timeline.
